Terms of Service

Template notice: These terms are a starting-point template, not legal advice. They have not been reviewed by an attorney. Have a lawyer review and adapt them — especially the guarantee, limitation of liability, and dispute sections — before you rely on them in production.

These Terms of Service ("Terms") govern your use of the services provided by Review Propeller ("Review Propeller," "we," "us," or "our"), a business based in Las Vegas, Nevada. By subscribing to or using our services, you ("you" or "Client") agree to these Terms.

1. The service

Review Propeller provides automated review-request services. We send messages by text and email to your own customers, on your behalf and at your direction, inviting them to leave a review on a public platform such as Google. Depending on your plan, the service may also include review reporting, AI-assisted review replies, a website review widget, and negative-review alerts.

We are a service provider. We do not write reviews, we do not control what your customers say, and we do not control the platforms where reviews are posted.

2. No long-term contract; cancellation

  • Service is billed monthly in advance. There is no long-term contract and no minimum term.
  • You may cancel at any time. Cancellation takes effect at the end of your current billing period.
  • We do not prorate or refund partial months, except as required by law or as expressly provided under the guarantee in Section 3.
  • We may suspend or terminate service for non-payment or for violation of these Terms.

3. The Review Propeller Guarantee

We offer the following guarantee: if you do not receive more reviews during your first 60 days of active service than you received during the 6 months immediately preceding the start of service, we will continue to provide the service at no charge until you do.

The guarantee is subject to the following conditions:

  • Baseline. Your prior 6-month review count is established from your public listing at the time service begins. We will document this baseline with you at onboarding.
  • Active service. The 60-day period requires continuous, active, paid service. It begins when your campaign goes live, not when you sign up.
  • You must supply customers. The service can only ask people you have actually served. You must provide valid, current customer contact data on a regular basis, in reasonable volume for your business. If we have no one to contact, the guarantee does not apply.
  • No interference. The guarantee does not apply if you pause the service, materially delay onboarding, block or restrict message sending, or ask us to limit outreach.
  • What "free" means. If the guarantee is triggered, we waive your monthly fee and continue working until the threshold is met. The guarantee is a service credit — it is not a cash refund, and it is not a guarantee of any specific number of reviews, star rating, ranking position, revenue, or lead volume.
  • Platform actions. Reviews removed, filtered, or withheld by Google or another platform are outside our control and are counted as posted where we can evidence they were submitted.

4. Your responsibilities

  • Consent and lawful contact. You represent that you have a lawful basis and any required consent to contact each customer whose information you provide to us, at the number and address provided. You are responsible for compliance with the TCPA, CAN-SPAM, and other applicable communications laws as they apply to your customer relationships.
  • Accurate data. You will provide accurate, current customer information and will promptly tell us about any opt-out or do-not-contact request you receive directly.
  • Your account. You are responsible for activity under your account credentials and for keeping them secure.
  • Payment. You authorize us to charge your payment method the recurring monthly fee for your plan until you cancel.

5. Acceptable use — honest reviews only

This is not negotiable, and it protects you as much as us. You agree that you will not, and will not ask us to:

  • Create, buy, sell, solicit, or incentivize fake reviews, or reviews from anyone who is not a genuine customer.
  • Offer any payment, discount, gift, or other incentive in exchange for a review or for a particular rating.
  • Engage in review gating — screening customers to route only happy ones toward leaving a public review while diverting unhappy ones elsewhere.
  • Suppress, hide, or retaliate against honest negative reviews.
  • Misrepresent who you are or what your business does.
  • Use the service to send anything unlawful, harassing, deceptive, or unrelated to a review request.

These practices violate Google's policies and may violate FTC rules and other law. We will refuse any such request, and we may suspend or terminate your account immediately if you engage in them.

6. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Specifically, and without limiting the above:

  • We do not control Google or any other review platform. We have no control over their policies, algorithms, filters, ranking systems, or decisions to display, withhold, or remove any review or listing. Those platforms may change at any time without notice.
  • We do not guarantee any specific star rating, review count, search ranking, traffic, lead volume, or revenue outcome, except as expressly stated in the guarantee in Section 3.
  • We do not control what your customers write. Reviews generated through the service are the independent opinions of your customers. You may receive negative reviews. That is the nature of honest review generation.
  • We do not guarantee that the service will be uninterrupted, error-free, or that every message will be delivered. Carriers and email providers may delay, filter, or block messages.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REVIEW PROPELLER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE, WHETHER IN CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID US IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

8. Indemnification

You agree to indemnify and hold harmless Review Propeller from any claims, damages, losses, and costs (including reasonable attorneys' fees) arising from your breach of these Terms, your customer data, your lack of required consent to contact your customers, or your violation of any law or third-party platform's policies.

9. Intellectual property

We retain all rights in our platform, processes, templates, and materials. You retain all rights in your business data, customer data, and content you provide. You grant us a limited license to use that material solely to provide the service to you.

10. Confidentiality and data

Each party will protect the other's non-public information. Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms.

11. Changes to the service or these Terms

We may modify the service or these Terms. We will provide notice of material changes to active clients. Changes take effect at your next billing period. If you do not agree, your remedy is to cancel — which you can do at any time.

12. Governing law and venue

These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the service will be brought exclusively in the state or federal courts located in Clark County, Nevada, and both parties consent to jurisdiction and venue there.

13. Miscellaneous

  • If any provision is held unenforceable, the rest remains in effect.
  • Our failure to enforce a provision is not a waiver of it.
  • You may not assign these Terms without our written consent. We may assign them in connection with a merger or sale of assets.
  • These Terms, together with the Privacy Policy and your plan details, are the entire agreement between us.
